Nigeria Data Protection Commission Inaugurates Committee for Implementation Directive

The Nigeria Data Protection Commission (NDPC) continues to take significant steps towards the implementation and enforcement of the Nigerian Data Protection Act (NDPA). In its latest move, the NDPC has inaugurated a national committee to focus on the General Application and Implementation Directive (GAID) of the NDPA.

Dr Vincent Olatunji, the National Commissioner of NDPC, officially inaugurated the committee, underlining its importance in ensuring a smooth compliance procedure under the NDPA. The committee will be responsible for addressing providence guidance on technical and organizational measures data controllers and processors are expected to take in order to protect the privacy of data subjects.

One of the primary objectives of the committee is to establish data security and data sovereignty. With the increasing number of cyber threats and data breaches, it is crucial for organizations to implement robust measures to protect sensitive information.

The committee will also play a vital role in providing clarity on various terms and concepts mentioned in the NDPA. This includes areas such as child consent, data subjects' rights, lawful basis of data processing, registration of data controllers and data processors, and cross-border data transfers.

By providing clear definitions and guidelines on these topics, the NDPC aims to ensure organizations fully understand their obligations and responsibilities under the NDPA. This will help prevent misunderstandings and discrepancies, promoting a more secure and transparent data protection environment in Nigeria.

Mr Babatunde Bamigboye, the Head of Legal, Enforcement and Regulations at the NDPC, has been appointed as the chairperson of the committee. His extensive experience and expertise in data protection and privacy issues will prove valuable in leading the committee's efforts.

To ensure a comprehensive and inclusive approach, the committee comprises of eight members and will also be co-chaired by Mr Tokunbo Smith of the Association of Licensed Data Protection Organizations of Nigeria.

The committee will work diligently to develop the General Application and Implementation Directive (GAID), which will serve as a practical guide for organizations to comply with the NDPA. This will help organizations understand the necessary measures they need to undertake to protect data subjects and ensure data privacy.
