In the tribunal's ruling, it was noted that witnesses and ballot papers were presented in relation to the allegations of over-voting. However, the petitioner failed to provide the necessary specific details and evidence to substantiate the claim. The ballot papers presented in court could not be traced back to their origin, weakening the petitioner's argument.

As a result, the tribunal concluded that Oguerinwa Amadi failed to prove his case beyond a reasonable doubt. The election of Osita Ngwu was therefore affirmed, validating his position as the elected senator for Enugu West District.

This ruling reinforces the earlier decision made by the Independent National Electoral Commission, which declared Ngwu as the winner, and highlights the importance of presenting strong evidence in election petitions. The tribunal's judgment serves as a reminder that allegations must be presented clearly and supported by concrete facts in order to sway the outcome of an election.
