The presiding judge of the Benue state High Court sitting in Gboko, D.M Igyuse, has delivered his ruling on the suit seeking to reinstate Iyorchia Ayu as the national chairman of the Peoples Democratic Party (PDP). The verdict was given on Thursday, August 31.

The case was filed by Nongo Ordue on behalf of the 17-member executive of Ayu's Igyorov council ward of Gboko LGA. They asked the court to set aside Ayu's suspension as a PDP member and reinstate him as the party's national chairman.

In response, counsel to the PDP, Clement Mue, argued that the suit constitutes an abuse of the court process since a similar case had already been addressed in the high court in Makurdi.

Judge Maurice Ikpambese ruled in the Makurdi case that Ayu could no longer hold the position of PDP national chairman, as he had lost his party membership at his ward. The plaintiffs had also filed a similar claim in another Gboko court, which was struck out on June 27.

Based on these circumstances, Judge Igyuse dismissed the case, labeling it "the worst form of abuse of court process."

It should be noted that Ayu, hailing from the Igyorov Ward in Gboko local government area of Benue State, claimed that his ward leaders do not have the statutory power to suspend him. However, the court ruling maintains his suspension due to loss of membership.
